Notice under Article 15(3) of the Town and Country Planning (Development Management Procedure)(England) Order 2015

Notice under Article 15(3) of the Town and Country Planning (Development Management Procedure)(England) Order 2015 and Section 68(1) of the Marine and Coastal Access Act 2009 of applications accompanied by an Environmental Statement Proposed development at the eastern extent of the Port of Lowestoft Outer Harbour.

Notice of Associated British Ports (ABP)’s applications to both East Suffolk Council and the Marine Management Organisation (MMO) for the necessary consents and approvals detailed below to develop the Lowestoft Eastern Energy Facility, accompanied by an Environmental Statement.

The applications submitted consist of:

(i) An application to East Suffolk Council under Regulations 73 to 75 of The Conservation of Habitats and Species Regulations 2010;

(ii) A Prior Approval application to East Suffolk Council under Part 18, Class A of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended);

(iii) An application to the Marine Management Organisation to undertake a regulated activity under Part 4 of the Marine and Coastal Access Act 2009; and

(iv) An application to the Marine Management Organisation for Local Act Consent under the Great Eastern Railway (General Powers) Act 1878 and the Great Eastern Railway Act 1902. 

The Environmental Statement accompanying the applications has been prepared in accordance with both the Town and Country Planning (Environmental Impacts Assessment) Regulations 2017 and the Marine Works (Environmental Impact Assessment) Regulations 2007 (as amended).

 A copy of the application and Environmental Statement, or as the case may be, supplementary information is available for inspection by appointment only at the ABP Port of Lowestoft office for a period of 42 days from the date of the first notice 21/05/21 . Members of the public may request an appointment (free of charge) or obtain copies of the Environmental Statement from ABP by contacting Lowestoft@abports.co.uk. Hard copies are available so long as stocks last and for a fee of £225. 

Copies of the Environmental Statement or supplementary information may be viewed on line on the Public Register at www.gov.uk/ check-marine-licence-register or http://publicaccess.eastsuffolk.gov.uk/online-applications/. Copies of the environmental statement may also be inspected free of charge and by prior appointment at the offices of the Marine Management Organisation, Newcastle upon Tyne. Anyone wishing to make representations about the Regulations 73-75 and Prior Approval applications should write to the council at the Planning Office, Riverside, 4 Canning Road, Lowestoft, Suffolk, NR33 0EQ or e-mail planning@eastsuffolk.gov.uk. 

Representations in respect of the Marine Licence application should ordinarily be made by visiting the MMO public register at: https://marinelicensing.marinemanagement.org.uk/mmofox5/fox/live/MMO_PUBLIC_REGISTER/search?area=3 and accessing the ‘make a comment’ section of case reference MLA/2021/00190; 

However, the MMO will also accept representations via the following formats:

 - By email to marine.consents@marinemanagement.org.uk; or alternatively

 - By letter addressed to Marine Management Organisation, Lancaster House, Hampshire Court, Newcastle upon Tyne, NE4 7YH

In all cases, correspondence must:

 - Be received within 42 days of the date of the first notice 21/05/21;

 - Quote the case reference (DC/21/2190/PN3 for the Regulations 73-75 and Prior Approval applications and MLA/2021/00190 for the Marine Licence application); and

 - include an address to which correspondence relating to the representation or objection may be sent.

 Copies of any objection or representation received will be passed on to the applicant.
